PORTAL POINT
1. GENERAL PROVISIONS
1.1. This agreement (hereinafter referred to as the “Agreement”) governs the terms of earning, using, and potentially exchanging game points (hereinafter referred to as “Points”) in the game PORTAL POINT (hereinafter referred to as the “Game”).
1.2. This Agreement is a legally binding document between the user of the Game (hereinafter referred to as the “Player”) and the Administration of the Game (hereinafter referred to as the “Administration”).
1.3. By using the Game and Points, the Player agrees to the terms of this Agreement.
2. STATUS OF POINTS
2.1. Points are an in-game digital resource intended exclusively for gaming purposes.
2.2. Points are not digital assets, cryptocurrency, electronic money, a payment instrument, financial instruments, or goods. They do not have real-world value and are not subject to purchase or sale.
2.3. Points can only be earned through active participation in the Game. They cannot be purchased for money, transferred between Players, or sold to third parties.
3. EARNING AND USING POINTS
3.1. Points are awarded to Players based on their activity in the Game, achievements, wins in in-game events, and other gaming mechanics defined by the Administration.
3.2. The game mechanics do not guarantee a fixed amount of Points to be earned. The number of Points a Player can earn is determined by both the game algorithms and the terms of the Loyalty Program.
3.3. The Administration has the right to change or discontinue any mechanics for earning Points without prior notice.
3.4. Points can only be used within the Game for purposes defined by the gaming process.
4. LOYALTY PROGRAM AND EXCHANGE OPTION
4.1. The Administration may, at its sole discretion, conduct temporary incentive campaigns (hereinafter referred to as the “Loyalty Program”), within which the exchange of Points for rewards, including but not limited to, TON cryptocurrency, may be offered.
4.2. Points cannot be exchanged for cryptocurrency directly through the application or in any other way. Players are only able to request the conversion of Points to TON tokens under the rules of the Loyalty Program.
4.3. Participation in the Loyalty Program is not mandatory, and the exchange of Points is entirely at the discretion of the Administration within the available limited reward fund.
4.4. The Loyalty Program is voluntary and temporary, and the Administration reserves the right to change, suspend, or terminate it at any time without explanation.
4.5. The Administration does not set a fixed exchange rate for Points to rewards, and participation in the Loyalty Program does not create any legal obligations on the part of the Administration.
4.6. The projected value of Points in TON tokens is estimate-based and not guaranteed. The Player understands that this value may fluctuate depending on the terms of the Loyalty Program and other factors.
4.7. The Administration has the right to refuse the exchange of Points for rewards if suspicious activity, fraud attempts, rule violations, or the use of automated tools for earning Points are detected. The Administration’s decision in such cases is final and not subject to appeal.
5. POINT STORAGE AND BURNING
5.1. Players may accumulate Points without the obligation to exchange them for rewards. Points that have not been used for exchange remain in the Player’s account and are not forfeited.
5.2. Points are burned only when they are converted to rewards under the Loyalty Program. Once successfully exchanged, Points are permanently destroyed (burned) and cannot be restored.
5.3. Points may be forfeited by the Administration if violations of this Agreement or suspicious activity on the part of the Player are detected.
6. AML AND KYC COMPLIANCE
6.1. The Player agrees that the Administration may request information from them for compliance with AML (Anti-Money Laundering) and KYC (Know Your Customer) regulations in the context of the Loyalty Program and/or the exchange of Points for TON tokens.
6.2. If the Player refuses to provide the required information or undergo the KYC process, the Administration reserves the right to refuse the exchange of Points and/or suspend the Player’s participation in the Loyalty Program.
6.3. The Player confirms that the information provided is accurate and up to date and agrees to promptly update the data in the Game if any changes occur.
7. DISCLAIMER OF WARRANTIES
7.1. The Administration does not guarantee:
• The availability of the Loyalty Program in the future.
• The possibility of exchanging Points for any assets, including cryptocurrency.
• Any minimum or fixed value for Points.
• A fixed amount of Points available for earning in the Game.
7.2. The Administration is not obligated to redeem Points from Players and reserves the right to refuse the exchange without explanation.
8. LIMITATION OF LIABILITY
8.1. The Player understands and agrees that Points cannot be considered their property or assets with monetary value.
8.2. The Administration is not responsible for any losses or damages incurred by the Player related to the expectation of receiving rewards from the Loyalty Program.
8.3. The Administration is not liable for any changes in the value of Points, including any consequences related to their exchange for TON tokens.
9. FINAL PROVISIONS
9.1. The Administration has the right to make changes to this Agreement. Changes will take effect as of their publication in the Game.
9.2. Continuing to use the Game after the changes have been made indicates the Player’s acceptance of the updated terms.
9.3. Matters not governed by this Agreement are regulated by the applicable laws of the country where the Administration is registered.
